KEY LEGAL DEVELOPMENTS

The Competition Board decided to impose administrative fines on 5 (five) French private education institutions operating in Istanbul, based on their gross revenues for 2023 on the grounds that they determined the school registration fees, the elements constituting the fees and the salaries of Turkish teachers together.
The Competition Board, due to the fact that META stopped its activities in Turkey after the temporary injunction decision given in the investigation initiated on the suspicion that META abused its dominant position by connecting Threads and Instagram applications; decided to terminate the daily administrative fine imposed on META and to impose a total administrative fine of $335.730,707.20 for 70 (seventy) days between 20.02.2024-29.04.2024.
The Central Bank of the Republic of Türkiye continues to simplify macroprudential policies in a way that increases the functionality of the market mechanism and strengthens macro-financial stability. Within the framework of the practices within this scope, the Communiqué on Securities Registration in the Official Gazette dated 9 May 2024 has been repealed.
In accordance with the amendment to the Law on the Protection of Personal Data, the Personal Data Protection Authority has published the “Draft Regulation on the Procedures and Principles Regarding the Cross-Border Personal Data Transfer”.
On May 3, 2024, the Draft Law on the Amendment of the Turkish Commercial Code No. 6102 and Certain Laws was submitted to the Presidency of the Grand National Assembly of Türkiye.

PERSONAL DATA BREACH NOTIFICATIONS

 

Some of the explanations in the 10 (ten) personal data breach notifications made to the Personal Data Protection Board are as follows:

⊗Pinar Tekstil Tuh. Inş. ve Paz. Tic. Ltd. Şti.; the breach occurred between 23.04.2024- 25.04.2024 and was detected on 24.04.2024, the system used by the data controller was accessed by a cyber attacker who captured the user information of an admin account, the personal data categories affected by the breach; identity (name, surname), contact (mobile phone number, e-mail address) and customer transaction (shopping history of natural and legal persons) information, the number of people affected by the breach is 36,956, the relevant group of persons affected by the breach are customers, and the relevant persons can get information about the data breach via the website of the data controller (b2b.pinartekstil.com.tr) and the phone number 0850 241 76 70.

⊗Karcam Plastik ve Cam Sanayi Tic. Ltd. Şti. stated that the breach occurred as a result of a cyber-attack, some of the company data was encrypted and a ransom was demanded from the data controller, the breach started on 13.04.2024 and was detected on 22.04.2024, the personal data categories affected by the breach are; identity, communication, location, personal, legal transaction, customer transaction, physical space security, transaction security, risk management, finance, professional experience, marketing, audio and visual records, the categories of sensitive personal data affected by the breach are; disguise and clothing, health information, biometric data, criminal conviction and security measures, the number of people and records affected by the breach could not be determined, the relevant groups of people affected by the breach are; employees, customers and potential customers, and the relevant persons can receive information about the data breach via karcam@hs03.kep.tr registered electronic mail (KEP) address.

⊗In the notification of Titiz Bebek ve Sağlık Ürünleri A.Ş. and Titiz Gayrimenkul Yatırım ve İnşaat Sanayi Ticaret A.Ş.; it was stated that the breach occurred as a result of a cyber- attack, some of the company data was encrypted and a ransom was demanded from the data controller, the breach started on 13.04.2024 and was detected on 22.04.2024, the personal data categories affected by the breach are: identity, communication. location, personal, legal transaction, customer transaction, physical space security. transaction security, risk management, finance, professional experience, marketing. audio and visual records, the categories of sensitive personal data affected by the breach are; disguise and clothing, health information, biometric data, criminal convictions and security measures, the number of people and records affected by the breach could not be determined, the relevant groups of people affected by the breach are employees, customers and potential customers, and the relevant persons can receive information about the data breach via titizbebek@hs03.kep.tr and titizgayrimenkul@hs03.kep.tr registered electronic mail (KEP) addresses.
