As part of the Mobile Ecosystems Sector Inquiry, the Competition Board launched an investigation against Apple for abusing its dominant position by requiring app developers to use its own payment system. |
With the amendment made to the General Communiqué on Tax Procedure Law, financing and savings financing companies operating within the scope of Law No. 6361 and payment and electronic money institutions operating within the scope of Law No. 6493 will issue receipts for transactions subject to BITT, and invoices for deliveries and services subject to VAT, other than transactions subject to BITT. The provisions of the regulation regarding financing and savings finance companies will come into force on 01.07.2024, and the provisions regarding payment and electronic money institutions will come into force on 01.01.2025. The remaining provisions will come into force on 12.06.2024. |

The amendment to the Communiqué on Supporting Conversion of Firms’ Foreign Exchange Sourced from Abroad into Turkish Lira came into force on 10.06.2024. With the new regulation, the obligation to sell foreign currency to the Central Bank was reduced from 40 percent to 30 percent. Turkish Treasury and Finance Minister Mehmet Şimşek stated that their simplification efforts will continue. |

Pursuant to the Constitutional Court’s concrete norm review decision numbered 2024/10 anddated 04.04.2024, published in the Official Gazette dated 6 June 2024 and numbered 32568,the phrase in the second paragraph of Article 297 of the Enforcement and Bankruptcy Law No.2004, which stipulates that the court must obtain the consent of the creditors’ board beforegranting permission to the debtor in order to carry out the disposals specified in the samearticle, was found to be contrary to Articles 5 and 35 of the Constitution and was rescinded bythe Constitutional Court. The Constitutional Court ruled that the said regulation restricts the rightand duty of the court to make independent judgements through third parties and conflictswith the positive liabilities of the state including the protection of the property right.
