ÖNE ÇIKAN HUKUKİ GELİŞMELER

Rekabet Kurulu, yürütülen Mobil Ekosistemler Sektör İncelemesi kapsamında Apple’a uygulama geliştiricilere kendi ödeme sistemini zorunlu tutmak suretiyle hâkim durumunu kötüye kullandığı şüphesiyle soruşturma başlattı.
Vergi Usul Kanunu Genel Tebliği’nde yapılan değişiklik ile 6361 sayılı Kanun kapsamında faaliyet gösteren finansman ve tasarruf finansman şirketleri ile 6493 sayılı Kanun kapsamında faaliyet gösteren ödeme ve elektronik para kuruluşları; BSMV’ye tabi işlemleri için dekont, BSMV’ye tabi olan işlemleri dışında kalan KDV’ye tabi teslim ve hizmetleri için fatura düzenleyecek. Düzenlemenin Finansman ve tasarruf finansman şirketlerine ilişkin hükümleri 01.07.2024, ödeme ve elektronik para kuruluşlarına ilişkin hükümleri 01.01.2025 tarihinde yürürlüğe girecek. Kalan diğer hükümler 12.06.2024 tarihinde yürürlüğe girecek.
Yerel arama ve konaklama fiyatı karşılaştırma hizmetlerinde hakim durumunu kötüye kullandığı Rekabet Kurulu tarafından tespit edilen ve tedbir yükümlülüklerini yerine getirene kadar hakkında günlük idari para cezası uygulanmasına hükmedilen Google, belirlenen tedbirlere uymadığı 15.04.2024-21.05.2024 tarihleri için 482 milyon TL idari para cezası ödeyecek.
Firmaların Yurt Dışı Kaynaklı Dövizlerinin Türk Lirasına Dönüşümünün Desteklenmesi Hakkında Tebliğ’de yapılan değişiklik, 10 Mayıs 2024 tarihinde yürürlüğe girdi. Yeni düzenleme ile Merkez Bankası’na döviz satış yükümlülüğü yüzde 40’tan yüzde 30’a indirildi.

RESMÎ GAZETE

6 Haziran 2024 tarihli ve 32568 sayılı Resmî Gazetede yayımlanan 2024/10 esas numaralı ve 04.04.2024 karar tarihli Anayasa Mahkemesi somut norm denetimi kararı uyarınca, 2004 sayılı İcra ve İflas Kanunu’nun 297. maddesinin ikinci fıkrasında yer alan, mahkemenin aynı maddede belirtilen tasarruf işlemlerini yapabilmesi için borçluya vereceği izinden önce alacaklılar kurulunun muvafakatini almasını öngören ibare, Anayasa’nın 5. ve 35. maddelerine aykırı bulunarak Anayasa Mahkemesi tarafından iptal edilmiştir. Anayasa Mahkemesi söz konusu düzenlemenin mahkemenin bağımsız karar verme hak ve ödevinin üçüncü kişiler ile kısıtladığına ve devletin mülkiyet hakkının korunmasına ilişkin pozitif yükümlülükleriyle bağdaşmadığına karar vermiştir.
