📌 KEY LEGAL DEVELOPMENTS

The Competition Authority concluded its investigation into İntema İnşaat ve Tesisat Malzemeleri Yatırım ve Pazarlama A.Ş. It was found that the company restricted competition by setting resale prices, and a settlement was reached with an administrative fine of 64.8 million TRY imposed.

The Competition Authority concluded its investigation into MAÇKOLİK. Due to anti-competitive advertising contracts and discriminatory practices, the company was fined approximately 13 million TRY, and it was obligated to establish a transparent and non-discriminatory system for advertising spaces.

The Competition Authority published the Impact Analysis Report covering 2023-2024. According to the report, interventions in competition violations such as cartels, resale price fixing, and abuse of dominant position contributed a total consumer benefit of 212.23 billion TRY (6.72 billion USD).

The Turkish Grand National Assembly (TBMM) accelerated efforts to create a legal framework for artificial intelligence in Turkey. The Chairman of the AI Research Commission, Dönmez, stated that the goal is to establish a national AI ecosystem shaped by stakeholders from various sectors, working on balanced regulations that include ethical rules and responsibility principles.

The Central Bank of the Republic of Turkey’s Monetary Policy Committee announced a decision to reduce the policy rate, the one-week repo auction interest rate, from 45% to 42.5%. The decision considered improvements in the main inflation trend and the effects of monetary policy on domestic demand and financial conditions.

The European Commission proposed amendments to the EU Border Carbon Adjustment Mechanism Regulation and published a draft aimed at reducing carbon leakage risks.

📜 OFFICIAL GAZETTE

In the Official Gazette dated 05.03.2025, issue no. 32832, a Regulation amending the Settlement Regulation on Administrative Fines applied under Law No. 6502 on Consumer Protection was published. The amendment mandates submission of authorization documents with settlement applications and allows applications to be submitted by registered mail.

In the Official Gazette dated 08.03.2025, issue no. 32832, a Regulation amending the Regulation on Electronic Commerce Service Providers (ETHS) and Electronic Commerce Intermediary Service Providers (ETAHS) was published. The changes cover withdrawal periods, advertising and discount budgets, e-commerce licensing fees, among other matters.

In the Official Gazette dated 06.03.2025, issue no. 32833, General Directive No. 2025/3 on Preventing Psychological Harassment (Mobbing) at Workplaces was published, aiming to protect employees from mobbing and impose various obligations on employers to provide safer and more peaceful working environments.

In the Official Gazette dated 08.03.2025, issue no. 32835, a Regulation amending the Authorization Regulation related to the Postal Sector was published. Following EU examples, postal services have been included within the postal sector scope, with authorization and supervision conditions set to ensure service quality, consumer satisfaction, and shipment security.

🔒 DATA BREACH NOTIFICATIONS

In a data breach notification submitted to the Board by Anadolu Anonim Türk Sigorta Şirketi, it was stated that the breach occurred between 25.02.2025 and 26.02.2025 and was detected on 26.02.2025. A development was implemented within the data controller’s system to automatically send documents related to policies when the policy was produced, which went live on 25.02.2025. For about two days, documents related to both individual and group health products were automatically sent. Despite some group health product customers having their disease information (disease letter) excluded from the policy coverage, this information was transmitted to the companies insuring these customers, causing the breach. The affected group consisted of customers, numbering 242 persons. The personal data involved included names, surnames, insured addresses, policy numbers, and health information. Affected individuals were informed that they could obtain information about the breach through the data controller’s call center, customer communication platform, and other communication channels.
