With the Communiqué published by the Ministry of Commerce, the monetary limit for the obligation to apply to the Consumer Arbitration Committee was updated as ₺104,000, effective as of 1 January 2024.
With the Regulation Amending the Price Label Regulation published in the Official Gazette dated 19 December 2023, the obligation for work places providing food and beverage services to display tariff and price lists at the entrances and tables where services are provided has been regulated, to be effective as of 1 January 2024.
With the decisions of the Supreme Election Board dated 19 December 2023, various propaganda restrictions have been determined to be valid until the election date. These include prohibitions such as sending visual, audio, and written propaganda messages or e-mails and giving gifts to citizens.
At the December meeting held by the Advertising Board, which operates under the Ministry of Commerce, 139 of 171 files were decided to be violated and an administrative fine of approximately ₺22 million was imposed. The main violations were evaluated as the use of the expression “the best” without being proven by independent research institutions and the use of misleading statements on product packaging.
The Competition Board deemed the intervention by the company, operating in the air conditioning sector, namely Uğur, in the resale prices of sellers and online sales as a violation of competition and imposed an administrative fine of approximately ₺51 million.

HIGH COURT DECISIONS

The Turkish Constitutional Court (the “Court”) has ruled that the mandatory mediation requirement for disputes regulated by article 73/A of the Law on Consumer Protection No. 6502 is not contradictory to the interest of consumer protection and does not violate fundamental rights and freedoms. (P:2020/73, D:2023/181)

The Court has deemed it contrary to fundamental rights and freedoms for the initiation of an investigation and prosecution on charges related to terrorism to be considered a just cause for the termination of an employment contract. Accordingly, the court has decided for a retrial. (AN:2019/14893, D:20.09.2023)

PERSONAL DATA BREACH NOTIFICATIONS

A data base company namely, MongoDb, reported a personal data breach to the Personal Data Protection Board occurred by a third party; the categories of personal data affected by the breach are identity, contact, personnel information, transaction security, customer transaction information and professional experience information; the affected groups of individuals include employees, customers, and potential customers and it has been announced that the number of affected individuals is between 130,000 and 160,000.
