With the Regulation Amending the Regulation on the Trade of Second-Hand Motor Land Vehicles, which entered into force after being published in the Official Gazette dated 13.12.2023, the scope of the ban on sales and marketing until 6 months and 6 thousand kilometers have passed from the date of the first registration has been expanded by including motorcycles. |
In order to ensure effective competition and reveal the formation of cartels, the Regulation on Active Cooperation for the Purpose of Disclosing Cartels was published in the Official Gazette dated 16.12.2023 and entered into force. With this regulation, mechanisms for immunity from penalties and penalty reductions have been established for enterprises, business associations, and their managers or employees who cooperate, aiming to expose cartels. |

In the investigations initiated by the Competition Board against Meysu and Seher Gıda, operating in the beverage industry, it was determined that competition was violated by determining resale prices, and an agreement was reached to impose a total of approximately ₺180 million in administrative fines. |

HIGH COURT DECISION
The Turkish Constitutional Court (“TCC”) ruled that the unjustified rejection of the appeal to the Criminal Judgeship of Peace against the administrative fine imposed on the data controller by the Personal Data Protection Board was a violation of rights and ordered a retrial. (AN:2020/7518, DD:12.10.2023)
The Court has considered the punishment of individuals committing crimes on behalf of a terrorist organization without being a member of the armed terrorist group, as an additional penalty for membership, to be a violation of rights. As a result, the relevant regulation has been annulled, and the decision will come into effect 4 months after the publication date in the Official Gazette (08.12.2023). (P.2023/182, D.2023/183)
